Software license terms for Genie9 desktop applications

Important - Read Before Installing

This End User License Agreement ("EULA") is a legal agreement between you and Genie9 Ltd for the use of BigMind Desktop, GCloud Desktop, and other Genie9 software products ("Software"). By installing or using the Software, you agree to be bound by these terms.

1. Grant of License

Genie9 grants you a limited, non-exclusive, non-transferable license to:

Personal License

  • • Install and use the Software on up to 3 personal devices
  • • Create backup copies for archival purposes
  • • Transfer the license to a new device you own

Business License

  • • Install on the number of devices specified in your order
  • • Deploy using your organization's software distribution
  • • Reassign licenses to different devices/users

Trial License

  • • Use all features for the trial period (usually 30 days)
  • • Convert to paid license anytime
  • • No feature limitations during trial

2. License Restrictions

You may NOT:

  • ✗Reverse engineer, decompile, or disassemble the Software
  • ✗Modify, adapt, or create derivative works
  • ✗Rent, lease, lend, sell, or sublicense the Software
  • ✗Remove or alter any proprietary notices
  • ✗Use for illegal purposes or violate export laws
  • ✗Share license keys or authentication credentials
  • ✗Use in a service bureau or hosting environment without permission

3. Intellectual Property Rights

The Software is protected by copyright and other intellectual property laws:

  • Genie9 retains all rights, title, and interest in the Software
  • This license does not grant you any ownership rights
  • Trademarks remain the property of Genie9
  • Third-party components are subject to their own licenses

4. Updates and Support

Software Updates

  • • Perpetual licenses: Include 1 year of updates
  • • Subscription licenses: Updates included during subscription
  • • Security updates: Critical patches may be mandatory
  • • Major upgrades: May require additional purchase

Technical Support

  • • Trial users: Community forum support
  • • Personal licenses: Email support included
  • • Business licenses: Priority support with SLA
  • • Enterprise: Dedicated support channels

5. Data Collection and Privacy

The Software may collect certain data to improve functionality:

  • • Crash reports and error logs (anonymized)
  • • Feature usage statistics (opt-out available)
  • • System configuration for compatibility
  • • License validation checks

6. Warranty Disclaimer

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. GENIE9 DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • • MERCHANTABILITY
  • • FITNESS FOR A PARTICULAR PURPOSE
  • • NON-INFRINGEMENT
  • • ERROR-FREE OR UNINTERRUPTED OPERATION

Some jurisdictions don't allow warranty exclusions, so these may not apply to you.

7. Limitation of Liability

IN NO EVENT SHALL GENIE9 BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • • Loss of data or profits
  • • Business interruption
  • • Computer failure or malfunction
  • • Any other commercial damages or losses

Our total liability shall not exceed the amount paid for the Software license.

8. Termination

This license is effective until terminated:

  • • You may terminate by uninstalling the Software
  • • Genie9 may terminate for license violations
  • • Termination requires deletion of all copies
  • • Perpetual licenses survive termination for archival use

9. Open Source Components

The Software includes open source components subject to their own licenses:

Common components include:

  • • SQLite (Public Domain)
  • • zlib compression (zlib License)
  • • OpenSSL (Apache License 2.0)
  • • Various MIT/BSD licensed libraries

10. Governing Law

This EULA is governed by the laws of England and Wales. Any disputes shall be resolved in the courts of London, UK. If any provision is found invalid, the remainder continues in full force and effect.
